Imagine if you will… an HHS Secretary hell-bent on banning pharmaceutical TV advertising and digital marketing in the United States – frustrated over the last two years by 1) a White House that pulled back a draft executive order, 2) having to publicly confess to Senators that advertising is commercial speech protected by the First Amendment, 3) a chilling FDA enforcement action that unintentionally created a 53% increase in Rx ads over the next six months, and 4) lack of support by FDA leadership to push a “loophole” de-facto Rx ad ban.

The entire Senate-confirmed FDA leadership has been removed, and there’s an announcement of a new federal rulemaking to “eliminate the option for prescription drug advertisements broadcast” by removing the "adequate provision" clause in FDA regulations and industry guidance by the end of this year.
